Environmental Injustice in Armed Conflicts

This paper examines whether existing international legal frameworks governing armed conflict deliver environmental justice, rather than episodic environmental protection. Using a Rawlsian justice-as-fairness lens, it conceptualizes access to a minimally safe environment as an environmental “primary good” and evaluates the law by four operational metrics: distributive impact, procedural access, prevention, and inter-generational protection. The paper maps the principal legal entry points in International Humanitarian Law (IHL)-including Additional Protocol I Articles 35(3) and 55, the principles of distinction, proportionality, and precautions, and rules protecting objects indispensable to civilian survival-alongside relevant specialized treaties and background principles of International Environmental Law (IEL). It then identifies three recurring structural gaps that impede justice outcomes: definitional indeterminacy and prohibitive thresholds; attribution and causation barriers amplified by wartime information asymmetry; and weak, politicized enforcement and reparations pathways. The analysis argues that without these shifts, the current regime predictably externalizes long-term environmental burdens onto civilians and future generations. It reframes compliance as a fairness obligation.
